Serbia Fiscalization and SEF for Personal Trainers 2026

In Serbia, a flat-rate trainer outside VAT is not obliged to use SEF, but every session and advance needs a fiscal receipt. The law explained article by article, with a table for trainers and gyms and the fines.

Does a flat-rate personal trainer in Serbia have to use SEF and a fiscal device?
Not SEF, as long as the trainer is outside the VAT system and does not bill the public sector: Serbia's Law on Electronic Invoicing ties that obligation to VAT payers. The fiscal receipt is a different story, and there is no exception: every session a private person pays for, including an advance for a package, goes through an electronic fiscal device, whether it was paid in cash, by card or by bank transfer.

This article covers Serbian law only. It is information, not tax advice. It relies on the consolidated texts of the Law on Electronic Invoicing (Zakon o elektronskom fakturisanju) and the Law on Fiscalization (Zakon o fiskalizaciji) published by Paragraf, on the Ministry of Finance answers on fiscalization in sport and on the Tax Administration (Poreska uprava) pages on fiscalization. Where sources disagree, the text of the law decides, so we cite it article by article.

Why sources disagree about flat-rate entrepreneurs and SEF
Search "paušalac SEF" (flat-rate entrepreneur and SEF, the state e-invoicing system) and you will find two claims. Most guides say a flat-rate entrepreneur outside VAT has no obligation. A few articles claim the flat-rate entrepreneur must issue an e-invoice as soon as they bill a company that is in VAT. The second claim does not hold, and here is why, step by step:
- Article 3 gives the obligation to issue e-invoices to private sector entities "on the basis of mutual transactions" and towards the public sector.
- Article 2, item 3) defines a private sector entity as a value added tax payer. A flat-rate entrepreneur outside VAT is not one.
- When you bill a gym that is in VAT, the transaction is not "mutual" between two private sector entities, so the Article 3 obligation does not arise. You issue a regular invoice, on paper or as a PDF.
- Under Article 2, item 4), a flat-rate entrepreneur becomes a "voluntary user" only by registering. Registration is required before you submit a payment request to a public sector entity (last paragraph of Article 2).
- Once you register, Article 5 says you must use SEF in the current and the following calendar year. Registering in November 2026 means an obligation until the end of 2027.

SEF or fiscal receipt: a table for trainers and gyms
| Situation | E-invoice through SEF | Fiscal receipt |
|---|---|---|
| Flat-rate entrepreneur outside VAT, client is a private person | No | Yes, for every session and every advance |
| Flat-rate entrepreneur outside VAT bills a gym or a company | No, unless they registered voluntarily | No, if the service is not provided in a retail facility (Article 3 of the Law on Fiscalization) |
| Flat-rate entrepreneur bills a school, a municipality or a public company | Yes, register before the payment request | No |
| Trainer or gym in VAT bills a company in VAT | Yes | Check whether it counts as retail |
| Gym sells memberships to private persons | No, retail is exempt | Yes |
The last row has two exceptions to the exception (Article 3, paragraph 2 of the Law on Electronic Invoicing): retail sales to a corporate card holder, and retail sales to a public sector entity if it asks for an e-invoice within seven days. Both apply only to those in SEF as VAT payers.
Fiscalization: a training session counts as retail
The Law on Fiscalization (Article 3) treats any provision of services to private persons as retail, and an advance received for such a sale is also subject to fiscalization. Article 4 obliges every person paying tax on self-employment income, which includes a flat-rate entrepreneur, to record every single retail sale "regardless of the method of payment", listing cash, instant transfer, cheque, payment card and other cashless payments.
The government can exempt certain activities, but sport is not one of them. In answers published by Paragraf, the Ministry of Finance stated that activity code 93 (sports, amusement and recreation activities) is not among the exempt activities. The same document says that a private person's payment to a club "for membership for the training service provided" must be recorded through a fiscal device. For a personal trainer it means the same thing: there is no category of "training that is not fiscalized".
The receipt is issued at the moment of the sale or when the advance is received (Article 6). If there is no internet connection, you send the data as soon as the connection returns, and within five days at the latest (Article 8).
Decisions for a trainer: Stripe, app stores, clients abroad, packages
- The client pays by card through Stripe or PayPal. This is still a retail sale to a private person. The payment platform only moves the money; you issue the fiscal receipt, and it shows the payment method.
- A 10-session package paid in advance. The law explicitly requires a fiscal receipt for the advance received. When the client uses up the package, the advance is closed with a final receipt; set up the receipt and transaction type with your accountant.
- A private client from abroad. The definition of retail in Article 3 makes no exception for foreign citizens. VAT and the place of supply are a separate question if you are a VAT payer, so settle that with your accountant.
- A foreign company orders online coaching. It is not retail if you do not provide the service in a retail facility, and a foreign company is not a private sector entity under Article 2 of the Law on Electronic Invoicing. You issue a regular invoice.
- The client buys through the App Store or Google Play. In Schedule 2 of its agreement with app developers, Apple states that it is responsible for collecting prices from end users. The client then pays the app store, not you, and you receive a payout. Before you decide whether to issue a fiscal receipt for such a sale, ask your accountant.
Fines under both laws
| Offence | Entrepreneur | Legal entity |
|---|---|---|
| Retail sale not recorded through a fiscal device, including an advance (Law on Fiscalization, Article 15) | 50,000 to 500,000 dinars | 300,000 to 2 million dinars |
| Breach of the duty to issue an e-invoice or use SEF (Law on Electronic Invoicing, Article 18) | 50,000 to 500,000 dinars | 200,000 to 2 million dinars |
The responsible person in a legal entity is fined separately, and a private individual who pays tax on self-employment income but is not a registered entrepreneur pays 20,000 to 150,000 dinars for an unrecorded sale (Article 15 of the Law on Fiscalization).
What changed in 2026 and what is coming
The amendments to the Law on Electronic Invoicing published in the Official Gazette of the Republic of Serbia ("Službeni glasnik RS") No. 109/2025 apply to tax periods starting after 31 March 2026. The latest amendments, from No. 80/2026, apply from 1 January 2027. We took the articles we cite from the consolidated text on Paragraf, which already includes the No. 80/2026 changes. The Law on Fiscalization was amended in the same issue of the Official Gazette. If you plan to enter VAT, and with it SEF as a private sector entity, that is the moment to talk to your accountant, before your first invoice.
If you run a gym in Serbia
Memberships paid by private persons are retail: a fiscal receipt for every payment, also when the member pays by bank transfer. The Law on Fiscalization defines a retail facility as a space used primarily to provide services to private persons, and a sale there is retail no matter who the buyer is. That is why corporate packages for employees are not automatically "just an invoice": check with your accountant whether it needs a fiscal receipt, an e-invoice or both.
Good practice is to see debts and payments in one place, so that no membership is left without a receipt. What that looks like day to day is described in how to track gym member debts and unpaid memberships.
Where Trainera helps and where it does not
Trainera does not issue fiscal receipts and does not send e-invoices to SEF. The agreement a trainer signs to take payments through the platform says the trainer alone is responsible for taxes and fiscal obligations and that Trainera is not their tax representative. The platform keeps records of clients, packages and payments: cash and bank transfers are recorded with a 0% platform fee, and online payments carry a fee by plan (Free and Starter 8%, Pro 5%, Business 3%, Enterprise 1%). Gyms pay no platform fee.
Trainer plans start at Starter for $19.99 a month, then Pro at $49.99 and Business at $99; gym plans start at Core for $119 a month. These are the US dollar prices. Prices are fixed per country, so a trainer or gym in Serbia sees prices in dinars on the pricing page. If you are looking for a way to charge clients monthly without a website, see the guide on recurring payments for personal trainers without a website.
Checklist before your next client payment
- Check whether you are in the VAT system. If you are not and you do not work with the public sector, SEF is not mandatory for you.
- Do not register for SEF "just in case": registration binds you for the current and the following year.
- Make sure your fiscal device issues receipts for advances, bank transfers and card payments.
- For companies outside a retail facility, issue a regular invoice with the buyer's tax number (PIB).
- Settle three questions with your accountant: advances for packages, clients from abroad and sales through app stores.
