Gym Membership Contract Rules in Switzerland (2026)

In Switzerland there is no general right of withdrawal for online purchases, and automatic renewal of a gym membership is generally allowed. What Art. 8 UWG protects, why the 2020 renewal bill was dropped, how Swiss contracts look, and the clauses to review.

What are the rules for gym membership contracts in Switzerland?

Swiss gym contracts are governed by general rules, mainly the Code of Obligations (OR) and the Unfair Competition Act (UWG). There is no general right of withdrawal for online purchases (SECO), and automatic renewal is generally allowed, often with a 3-month notice period before the term ends (CAP legal protection, 2026). What protects members is Art. 8 UWG, which lets a court strike out terms that create a significant and unjustified imbalance to the consumer's detriment.

The last two rows come from legal information sites, not from a statute or a court ruling quoted in full. They describe how the rules are usually read; a specific dispute can turn out differently.

Is automatic renewal of a gym contract legal in Switzerland?

In general yes: a clause that renews a 12-month contract unless the member cancels in time is allowed, as long as it does not create the kind of imbalance Art. 8 UWG targets.

According to CAP Rechtsschutz (2026), renewal clauses are common, the notice period is often 3 months before expiry, a court can assess a clause in the individual case, and some providers have dropped renewal clauses altogether. Nobody can tell you in advance at which point a clause becomes unfair; that depends on the whole contract. law.ch adds that a renewal clause taken over wholesale through general terms can be invalid as unusual, citing BGE 140 III 404.

The 2020 bill that was dropped

Parliament discussed a duty to remind customers before a contract renews, and it failed.

Parliamentary initiative 13.426 (Poggia), "tacit renewal of service contracts", wanted providers to inform customers before an automatic renewal, with gym memberships named as an example. The National Council approved it in the 2020 spring session, the Council of States rejected it in July 2020, and on 24 September 2020 the National Council voted not to continue (99 to 82), which ended the bill (SRF, 25 Sep 2020; Beobachter, 16 Jul 2020).

Our research for this post did not find a newer federal rule on renewals, but that is not proof that nothing has changed. Check the current law, or ask a lawyer, before you rely on it.

One thing to keep out of Swiss contracts and websites: the German "cancellation button" (Kündigungsbutton) is German law (§312k BGB). It does not come from Swiss law, so do not copy German wording about it into Swiss terms without legal advice.

Published examples from chains show the range (provider pages, checked 11 October 2026): Update Fitness lists an annual membership at CHF 699, or CHF 789 with a "Stopcard" for pausing. Activ Fitness lists annual memberships at CHF 599, 799 or 899 depending on how many studios you can use, and a "Swiss Fit" option at CHF 123 a month with a 12-month minimum term. Prices and conditions change, so check the provider page.

Health insurance also shapes contracts. Sanitas, for example, pays a share of the fee from supplementary insurance only if the center holds a Qualitop, QualiCert or Fitness-Guide label, with a minimum term of 3 months or a 10-visit pass for its Vital products (Sanitas). A gym that sells short trial memberships should know that, at Sanitas, members on shorter terms may not get a contribution. Basic insurance pays nothing toward gym memberships.

Clauses to check with a lawyer

These are the questions a lawyer will ask about your contract; the answers are yours to decide with them.

A test I find useful: read your renewal and notice clauses as if you were the member. If a reasonable member would be surprised by them, a judge applying Art. 8 UWG might be too.

Good practice that reduces disputes

Clear terms and timely reminders settle many arguments before they start.

  • Show term, renewal and notice period on the sign-up page and in the confirmation, not only in the general terms.
  • Remind members before the notice deadline. The law does not require it (the 2020 bill failed), but a reminder avoids the angry email in month 13. Our renewal reminder playbook shows a sequence.
  • Confirm every cancellation in writing with the end date.
  • Offer a pause before a cancellation. Some members want to stop for three months, not leave.
  • Keep the contract version each member signed, so you can show which terms applied to whom.
  • Write down how you handle good cause so reception staff answer the same way each time.

Frequently Asked Questions

Can I cancel a gym membership at any time in Switzerland?

Generally no. The legal information site law.ch lists how a fitness contract ends: when the agreed term runs out, by termination for good cause such as pregnancy, illness, accident or moving away, or the operator's bankruptcy. A right to cancel at any time is not on that list, so the agreed term and notice period usually count.

Is there a 14-day withdrawal right for gym contracts bought online in Switzerland?
